Purpose:

Officers have been requested to undertake a highway extent investigation into the Subject Land. The fields beyond have been purchased for development and the Purchasers' Solicitors seek to determine the extent of the highway.

 

Following investigation it is considered on balance of probability, that the Subject Land has been part of vehicular highway width for a significant number of decades, and been treated as, and recorded as such, on a variety of document. Inference of dedication at Common Law from all the circumstances is appropriate in this case. Similarly, the Subject Land and other land at this location was already part of vehicular highway width well before the CPO and SRO were completed.

 

The recommendation of this report is that the extent of the highway recorded at Lancashire County Council be amended to reflect that the "Subject Land" be shown as part of the highway width of Lea Lane and be maintainable at public expense, having been part of said width since before 1835.
