The purpose of this proposed order was to replace the previous motorway restrictions with a Prohibition of pedestrians, equestrians, cycles and horse drawn carriages due to the reclassification of the road.
Consultations
Formal consultation was carried out between 25 January-2024 and 22 February-2024 which included advertising in the local press and notices being displayed on site. Divisional county councillors were consulted along with the council's usual consultees and the consultation documents posted on the council's website.
Following formal consultation two objections were received on the grounds that the Department for Transport does not allow the prohibition of horses, therefore, it is not legally possible for a Traffic Regulation Order to exclude horse riders from a road as intended by this proposal.
On consideration of the objections, officers took legal advice which confirmed that the prohibitions regarding Equestrians contained within the draft Order would not be lawful and within the powers of the County Council under the 1984 Act.
In light of the legal advice a modification was carried out to remove the Prohibition of Equestrians and Prohibition of Horse Drawn Vehicles from the Order.
Formal consultation for the modification was carried out between 5 September-2024 and 3 October-2024 and subsequently both objections have been withdrawn.
Peter Bell, Regulation and Enforcement Manager, on behalf of the Matt Townsend, Director of Highways and Transport took a decision to approve the replacement of the previous motorway restrictions with a Prohibition of pedestrians, equestrians, cycles and horse drawn carriages due to the reclassification of the road.
