Key Decision definition: A key decision means an executive decision which is likely:
(a) to result in the council incurring expenditure which is, or the making of savings which are significant having regard to the council's budget for the service or function which the decision relates; or
(b) to be significant in terms of its effects on communities living or working in an area comprising two or more wards or electoral divisions in the area of the council.
For the purposes of (a) above, the threshold for "significant" is £2.2 million (from 1 April 2024).
A new access is to be constructed onto New
Road, Burnley. In order to reduce the speed of vehicles approaching
and navigating the new junction as well as providing additional
protection for all road users and pedestrians, it is proposed to
extend the existing 30mph speed limit.
The purpose of this proposal is to introduce a shortened extent of
derestricted speed limit along New Road that has resulted as a
consequence of extending the 30mph by virtue of street
lighting.
The proposals are being pursued as part of a s278 Agreement under
the Highways Act 1980 as part of a new development which will
introduce further traffic movements.

25 October-2024 which included advertising in the local press and

Formal consultation was carried out between 4 November-2022 and 2

These proposals were originally approved by Cabinet on the 2
February-2023. However during construction further comments were
received in relation to the times for the Prohibition of Driving
along the main section of Friargate.
Officer's Response
Having considered the responses officers reviewed the proposals to
introduce a prohibition of driving (except pedal cycles) 10am
– midnight and midnight to 6am with the intention of
introducing a less restrictive scheme which will alleviate the
concerns raised by the businesses in the area. A modification was
carried out to defer the proposal allowing the Order to be made in
part and an Experimental Order to progress with a Pedestrian and
Cycle Zone No Motor Vehicles except for Permit holders 6am-11am
whereby the restriction can be assessed to ensure adequate access
for businesses to undertake servicing and the city council to
undertake their duties.
Formal consultation of the modification was carried out between 27
September-2024 and 18 October-2024 which included notices being
displayed on site. Divisional county councillors were consulted
along with the council's usual consultees and the consultation
documents posted on the council's website.
No Objections were received in relation to the Modification to
defer the original Prohibition of Driving except cycles
10am-midnight and midnight-6am and make the order in part.

In response to questions from members, it was clarified that:
· The council's officers were in a regular conversation with the external auditors and covered Grant Thornton's five key questions relating to audit committee success as a matter of course. Nonetheless, the checklist served as a helpful reminder.
· The dates introduced by government to end the local government audit backlog would not affect Grant Thornton's audit plan or reports to the committee; however, the 28 February 2025 backstop would require both the auditors and the council to stick closely to their project plans.
· Following a review of governance, the council was in a good position to compare itself with the Code of Practice on Good Governance for Local Authority Statutory Officers. A report would be provided to the committee's next meeting on the current assurance level and to identify any further action.

It was noted that paragraph 4.2 of Appendix A should have set out that the number of incomplete management actions had reduced to 15, and there were no outstanding responses from management.
In relation to the audits which had received limited assurance, it was highlighted that the Internal Audit team were working with the relevant services to understand where improvements were needed.
In response to questions, members were informed that:
· The Quality Assurance and Practice Improvement Framework was a system used within Adult Services to assess the practice of social workers and ensure continuous improvement. There was a risk that, without continuous improvement and implementing Internal Audit's recommendations, the service could fall behind best practice.
· The audit of Discharge to Assess and Provider Payments was a big and complex piece of work, linked to capacity and a backlog of social care assessments. It was a priority for the council to resolve in order to limit the potential impact on care providers. Members' suggestion for improved transport capacity would be shared with the service as part of a holistic solution.
· The high-risk outstanding action from 2021/22 related to the frequency of DBS checks for employees. The changes recommended by Internal Audit would require a policy change and would have an impact on employees and financially. People Services were working to resolve the outstanding matters by the end of the financial year. The committee's feedback and hope for a resolution by its next meeting, in January, would be taken into account.

During the formal consultation it was brough to officer's attention that the Burnley area Permit Parking Order made in 2015 contained an administrative error in the eligibility for the Zone 7 Mansergh Street / Killington Street area of Burnley.
Therefore, a modification was carried out to define the exact residential address points that were included in the original 2014 Order that brough the zone into operation. Formal consultation for the modification was carried out between 27 September-2024 and 18 October-2024.
Following the formal consultation of both the proposals and the modification No Objections were received.

Lancashire County Council is the waste
disposal authority for the administrative county of Lancashire. The
Authority operates and manages 15 Household Waste Recycling Centres
(HWRCs), a Community Recycling & Re-use Centre (CRRC), two
transfer stations and is also responsible for the management of
wastes collected by Waste Collection Authorities, including
fly-tipped waste.
The aim of this procurement exercise is to procure services for the
collection, acceptance and processing of waste automotive batteries
from the HWRCs. The procurement relates to standard petrol and
diesel car batteries and may also include some leisure
batteries.
The previous arrangements for the waste automotive batteries have
generated an income for the Authority, with the suppliers paying
the Authority for the waste automotive batteries collected.
Under the proposed procurement the contract rates payable by the
supplier will be linked to the 'Non Ferrous Metal - Batteries'
prices published on Letsrecycle.com website for the month that the
waste batteries are collected, plus a fixed supplier adjustment
that will be tendered by the supplier. In addition, the supplier
will also be required to tender a collection rate for each waste
facility.
Current arrangements for service delivery are via a temporary
informal rolling agreement. This procurement is required to
formalise arrangements and put in place a more robust contract to
govern service delivery. It is recommended that a below threshold
open tender procedure is used to procure the services.
The framework agreement will be for an initial period of two years,
with the option to extend for any number of defined periods up to a
further two years. The intention is for service to commence on or
around 01 February 2025.

Following formal consultation two objections were received on the grounds that the Department for Transport does not allow the prohibition of horses, therefore, it is not legally possible for a Traffic Regulation Order to exclude horse riders from a road as intended by this proposal.
On consideration of the objections, officers took legal advice which confirmed that the prohibitions regarding Equestrians contained within the draft Order would not be lawful and within the powers of the County Council under the 1984 Act.
In light of the legal advice a modification was carried out to remove the Prohibition of Equestrians and Prohibition of Horse Drawn Vehicles from the Order.
Formal consultation for the modification was carried out between 5 September-2024 and 3 October-2024 and subsequently both objections have been withdrawn.

Lancashire County Council currently has three contracts in place for the Provision of Residual Waste Recovery/Disposal Services, all of which were awarded to Lancashire Waste Recycling Limited in 2022 following a mini-competition from the now-expired framework for the Provision of Residual Waste Recovery/Disposal Services let by Lancashire County Council in 2018.
The initial term for each contract commenced on 1 June 2022 and runs to 31 May 2025. All three contracts have the option to extend the contract for a further period, or periods, up to a maximum of 24-months in addition to the initial term.

A report was presented on an application for the diversion of part of footpath FP0312095 at the former Chipping Camping Barn, at Clark House Farm, Chipping.
The length of existing path to be diverted was shown on the Committee plan attached to the agenda papers as a bold continuous line and marked A-B, and the proposed alternative route was shown by a bold broken line and marked A-C-D-E.
The consultation with the statutory undertakers had been carried out and no objections or adverse comments on the proposal had been received.
Consultation with the Lancashire County Council Ecology Officer had been carried out with the recommendation that a pre-commencement survey of the watercourse be undertaken by a suitably qualified ecologist, to determine if there was any potential for impacts on water voles from the creation of a new crossing. It was noted that any advice from the ecologist on the need for further surveys, reasonable avoidance measures, licences etc would be adhered to throughout and that if any vegetation removal works were required, that these must be undertaken outside the bird nesting season (March to August inclusive).
It was reported that the proposed diversion was considered expedient in the interests of the owners of the land for reasons of privacy and security. The former Chipping Camping Barn, at Clark House Farm is a private, residential property. Currently, the public footpath ran along the access drive of, and immediately adjacent to, this dwelling.
The diversion would instead move the footpath from a point in the pasture just to the south of Clark House, to turn in a north-north-westerly direction over the ditch to the south of Meadow Hey, continuing in a north-north-westerly alongside the boundary, to turn in a north-easterly direction and onto Fish House Lane. This would significantly increase the privacy and security of the residential dwelling, whilst providing a route that was safe, convenient and as direct for public use.
Resolved:
(i) That an Order be made under Section 119 of the Highways Act 1980 to divert part of footpath FP0312095 from the route shown by a bold continuous line and marked A-B to the route shown by a bold broken line and marked A-C-D-E on the attached map.
(ii) That in the event of no objections being received, the Order be confirmed and in the event of objections being received and not withdrawn, the Order be sent to the Secretary of State for the Environment, Food and Rural Affairs and the Authority take a neutral stance with respect to its confirmation.
(iii) That provision be included in the Order such that it is also made under Section 53A of the Wildlife and Countryside Act 1981, to amend the Definitive Map and Statement of Public Rights of Way in consequence of the coming into operation of the diversion.

Officers have been requested to undertake a highway extent investigation into the Subject Land. The fields beyond have been purchased for development and the Purchasers' Solicitors seek to determine the extent of the highway.
Following investigation it is considered on balance of probability, that the Subject Land has been part of vehicular highway width for a significant number of decades, and been treated as, and recorded as such, on a variety of document. Inference of dedication at Common Law from all the circumstances is appropriate in this case. Similarly, the Subject Land and other land at this location was already part of vehicular highway width well before the CPO and SRO were completed.
The recommendation of this report is that the extent of the highway recorded at Lancashire County Council be amended to reflect that the "Subject Land" be shown as part of the highway width of Lea Lane and be maintainable at public expense, having been part of said width since before 1835.

Lancashire County Council is the Waste Disposal Authority for the administrative county of Lancashire. The Authority operates and manages fifteen Household Waste Recycling Centres (HWRCs), thirteen of which is where hard plastic waste can be deposited by members of the public.
Examples of hard plastics, sometimes called rigid plastics, include plastic storage containers; buckets and bins; plastic patio furniture; large children’s toys; plastic gutters, downpipes and utility pipes; wheelie bins; compost bins and water butts; plastic plant pots; car bumpers; and traffic cones and barriers.
Hard plastics can be recycled by sorting the plastics according to polymer type and cleaned, then shredding into flakes or melting into pellets, before being moulded into new goods.
Since April 2021, the Authority has been operating informal trial agreements to manage the disposal of hard plastics. These arrangements started out as a temporary measure as the Authority adjusted its waste management operations to accommodate separating out hard plastic from waste destined for landfill.
However, in recent months, the trial supplier has struggled to meet service delivery expectations and has at times been unable to accept hard plastic waste or requested significant increases in gate fee. As such, there is currently a pause on separating out hard plastic waste, with the waste instead going into the non-recyclable containers on the HWRCs and sent to landfill.
A formally procured contract is now required to fully test the market and comply with Public Contracts Regulations 2015.
The procurement will consist of two lots covering different areas of the county of Lancashire. The resulting framework agreements requires the acceptance and recycling of hard plastic that is delivered into the provider by the Authority and/or it's transport contractor from the HWRCs.
The framework agreements will be for an initial period of two years, with the option to extend for any number of defined periods up to a further two years, to commence on or around 01 February 2025.

A query relating to highway extent was received from colleagues in Highways Operations relating to a wall which may have footway in front but also a footway / footpath behind, with possible public right to pass down either side of the wall. The query is over whether the wall was maintainable at public expense by the highway authority.
Following the investigation it is considered that on balance of probability, the wall at back of footway forms the boundary of private land and therefore, both the wall at back of footway and the pathway on the Subject land do NOT form part of Lancashire County Councils highway extent, and are therefore not maintainable at public expense.
It is therefore recommended that the highway extent be amended to reflect that the wall in question forms the boundary of private land and as such, our maintained at public expense (MAPE) records should reflect that our highway extent stops at the wall, with the wall and passageway behind reflected as private land.

Lancashire County Council Officers have
undertaken a highway extent investigation into the culvert, which
is situated under the eastern end of Shaw Clough Street, where it
joins the C707 (Shaw Clough Road).
Following investigation it is recommended that the culvert is
confirmed as part of the highway extent and is therefore
maintainable at public expense.
The records held in the Highway Asset Management System (HAMS)
should be updated to confirm the culvert is question is
maintainable at public expense by Lancashire County Council.
