This report provides Cabinet with an update on the delivery of the Samlesbury Aerospace Enterprise Zone.

-  seeks approval for the county council to serve an Option Notice to enable the drawdown of land for the spine road, drainage and ecological purposes and enter into legal agreements necessary to discharge the county council's planning obligations in relation to the provision of off-site ecological mitigation as identified in the Local Development Order) for the Samlesbury Aerospace Enterprise Zone; and

-  provides Cabinet with an update on the proposed next stages of development at the Samlesbury Aerospace Enterprise Zone and also the marketing of the Zone and the Lancashire Enterprise Partnership's wider Lancashire Advanced Manufacturing and Energy Cluster initiative.

Queen Street Mill Museum and Helmshore Textile Mills Museum closed to the public at large on 30 September 2016. There has been no formal application from prospective new operators of the Mills museums and consequently a number of options for their future have been explored.

On 7 December 2017, Cabinet agreed to a statutory notice being published to begin a representation period on the proposed closure of Hameldon Community College, Burnley.  A statutory proposal document was published in relation to the proposed closure of the school, with implementation commencing from 31 August 2018.  The representation period took place from 16 January to 26 February 2018. 

As part of the statutory process, a decision should now be taken about the proposal and this will be done by Lancashire County Council, which is the decision maker.  If the authority does not make a decision within two months from the end of the consultation period, the proposal and any representations about the proposal must be passed to the schools adjudicator for a decision.

The Dementia Strategy, as set out at Appendix 'A', provides the strategic direction for Lancashire County Council in supporting people with dementia and their carers and families.  It aims to facilitate the development of a Dementia Friendly Lancashire which will support prevention, awareness, early diagnosis and support for people with dementia in partnership with other organisations.

We want to make a positive difference to the lives of people living with dementia and their carers, so they can be as independent as possible, for as long as possible, and feel understood and included, so they can confidently contribute to community life.

This report sets out a recommendation to amend the basis upon which the Cuerden Development Site – Earthworks procurement exercise will be undertaken. This report includes a revised estimated contract value of £3.8m, following the identification of additional works required as part of this procurement exercise since the original report was approved by Cabinet on 18 January 2018. The report provides detail on the additional works value identified for this project.

The reason for the rejection is that Councillor Morris has no funds available in his budget.

County Councillor Alan Vincent considered and approved a Local Member Grant of £600 to The Dream Team Singers for a new mobile PA system and new uniforms.

County Councillor Geoff Driver, the Leader of the County Council approved the recommendation as set out in the full report.

This decision should be implemented immediately for the purposes of Standing Order 35 as any delay could affect the business continuity of Marketing Lancashire Limited.

County Councillor Anne Cheetham considered and approved a Local Member Grant of £477.00 to Lancashire Cricket League towards the cost of various items of equipment for the club.

County Councillor Gillian Oliver considered and approved a Local Member Grant of £200 to Penwortham Holme West Allotment Association to replace tables and chairs.

County Councillor Tony Martin considered and approved a reduced Local Member Grant of £650 to Juice Sustainable Recovery Group towards their healthy eating and walking groups.

The reason for the reduction is that this is the amount remaining in Councillor Martin's budget.

County Councillor Stuart Morris considered and approved a Local Member Grant of £415 to Bolton-le-Sands Bowling Club for a counter top water boiler.

A report was presented on an application for the addition to the Definitive Map and Statement of a footpath from Albert Terrace passing through The Holme (Calder Vale) and continuing adjacent to a pond to meet Footpath 80 Barnacre with Bonds, Wyre Borough, as shown between points A-B-C-D-E on the Committee plan attached to the agenda papers.

The applicant had originally applied for a route from between 9 and 10 The Holme to point E, to be recorded as a public footpath but had not included the section of the route between points A-B or part of the route between points B-C.  Following discussion with the applicant, it was understood that she had only claimed the route from The Holme to point E as that was the section of the path to which access had been prevented, and the applicant had not realised that it was necessary to claim the full length.  The application had subsequently been revised to include the full length between points A-B-C-D-E.

The thirty four user evidence statements which had been submitted with the application had referred specifically to the route as running from between 9 and 10 The Holme to point E.  Thirty of the users had subsequently confirmed – by way of a signed plan on which they had drawn the full length of the route A-E – that their evidence related to the full length of the route.

A site inspection had been carried out on 14 June 2017. 

No adverse comments or objections had been received.  Barnacre with Bonds Parish Council had confirmed that they fully supported the application and that the route accessed from land between 9 and 10 The Holme, running along the mill pond to join the public footpath to Primrose Cottages, had been used by locals for over 70 years.

The Committee were advised that the way the route was recorded on documentary evidence was not in itself a sufficient circumstance from which dedication could be inferred.  Sufficient 'as of right' use may also be a relevant circumstance from which dedication can be inferred.  The described use of the route, as corroborated by the documentary evidence, as well as the treatment of the route by previous landowners, would suggest that it may reasonably be alleged that there are sufficient circumstances to infer dedication at common law.

Resolved: 

(i)  That the application for a public footpath to be added to the Definitive Map and Statement from Footpath 80 Barnacre with Bonds at Albert Terrace, passing through The Holme (Calder Vale) and continuing alongside a pond to rejoin Footpath 80, Barnacre with Bonds, Wyre Borough, in accordance with File No.804-587, be accepted.

(ii)  That an Order be made pursuant to Section 53 (2)(b) and Section 53 (3)(b) and/or Section 53 (3)(c)(i) of the Wildlife and Countryside Act 1981 to add to the Definitive Map and Statement of Public Rights of Way a footpath from a point on Footpath 80 Barnacre with Bonds at Albert Terrace, passing through The Holme and continuing adjacent to a pond to rejoin Footpath 80 Barnacre with Bonds as shown on Committee Plan between points A-B-C-D-E.

(iii)  That being satisfied that the higher test for confirmation can be met the Order be promoted to confirmation.

A report was presented on an application for the addition to the Definitive Map and Statement of a footpath from Garstang Road (A6) to Pinewood Avenue, Broughton, Preston City, as shown between points A-B-C-D-E-F on the Committee plan attached to the agenda papers.

A site inspection had been carried out on 13 September 2017.

The Committee noted that there was no map or documentary evidence to suggest that the application route existed as a through route before Pinewood Avenue and the associated housing development was built between 1965 and 1967.  The map evidence was not in itself sufficient to infer dedication under common law.  The land was in the ownership of BT during the relevant period under consideration.  BT objects to the application and have notices up mitigating against dedication.  Therefore, the mapping and user evidence taken together were considered as insufficient from which to infer dedication under common law.

Eleven user evidence forms had been submitted by the applicant.  Section 31 of the Highways Act provides that the route must have been enjoyed by the public as a whole.  However, the user forms suggest use was in fact by local inhabitants mainly residing at Pinewood Avenue and Willow Tree Close, and therefore it was not possible to demonstrate use by the public as a whole.

It is understood two notices had been put up along the route by the landowner, British Telecommunications (BT), which made it clear that the land was private property and that unauthorised access was trespass and not permitted.  The case officer suggests one of the notices was worn and weathered suggesting it had been in place for some time.  This is considered sufficient evidence to negative the presumed intention to dedicate the way as a highway.

Taking all the evidence into account, it was suggested to Committee that, on balance, the provisions of S31 Highways Act could not be satisfied and that dedication could not be deemed under Section 31 nor inferred under common law and hence it was recommended that the application was not accepted.

Resolved:  That the application for an addition of a footpath to the Definitive Map and Statement from Garstang Road to Pinewood Avenue, Broughton, in accordance with File No. 804-590, be not accepted.

A report was presented on the proposed diversion of part of Westby-with-Plumptons Footpath 7, Fylde Borough.

An application had been received from Network Rail to divert part of Westby-with-Plumptons Footpath 7, in connection with its proposal to replace Kirkham Tip Level Crossing with a stepped footbridge.

The length of the existing path proposed to be diverted was shown by a bold continuous line marked on the plan attached to the agenda papers as A-B.  The proposed alternative route was shown on the plan by a bold dashed line and marked A-C-D-E-F-B.

It was reported that the construction of a stepped footbridge would eliminate the risk to the public when crossing the operational railway.  The new route was marginally longer than the existing route but would require an equivalent number of steps to be negotiated as the existing route.  Given the substantial improvement in the safety of the crossing, it was suggested that this was reasonable.  In addition, users of the railway crossing that were in a hurry (and would be inconvenienced by waiting for a train to pass), may find a footbridge to be the preferred option.

The Committee noted that Network Rail had explored all alternative options for a permanent means by which the increased risk to the footpath users could be reduced.  Their preferred option was to provide a new stepped footbridge to ensure that the public could cross the railway safely.  It was reported that Network Rail had therefore applied for a Diversion Order to change the legal alignment of the footpath, to enable the level crossing to be closed when the footbridge was in place.

In the event that the Order is successful, Network Rail would ensure that the existing level crossing was removed, suitable fencing was erected to bar access to the railway and that appropriate signs were provided, advising potential users that the path had been diverted.

The Committee noted that consultation with the statutory undertakers had been carried out and that no objections or adverse comments on the proposal had been received.

Resolved:

(i)  That subject to satisfactory responses to the consultations, an Order be made under Section 119A of the Highways Act 1980 to divert part of Westbywith-Plumptons Footpath 7, from the route shown by a bold continuous line and marked A-B on the attached plan, to the route shown by a bold dashed line and marked A-C-D-E-F-B.

(ii)  That in the event of no objections being received, the Order be confirmed and in the event of objections being received and not withdrawn, the Order be sent to the Secretary of State and the Authority take a neutral stance with respect to its confirmation.

(iii)  That provision be included in the Order such that it is also made under Section 53A of the Wildlife and Countryside Act 1981, to amend the Definitive Map and Statement of Public Rights of Way in consequence of the coming into operation of the diversion.

A report was presented on an application for a bridleway to be recorded from Burnley Road to Antley Gate, Trawden, Pendle.

A previous application had been received in October 1984 from the Trail Riders Fellowship, to upgrade the footpaths from Burnley Road to Antley Gate, Trawden, to byway open to all traffic.  It had been considered by the Public Rights of Way Sub-Committee in July 1986 and rejected on the basis of insufficient evidence.

A further application had been received in October 2016, from different applicants, to upgrade most of the same route but this time to bridleway, with an addition of bridleway close to a short section of the route, as shown between points A-O on the Committee plan attached to the agenda papers.  This application included documentary and user evidence which had not been considered when the first application had been made. 

It was reported that the applicant had provided 10 user evidence statements to demonstrate usage over 20 years of the route, in addition to a bundle of documentation including maps, leaflets and references to several books, to try to illustrate that the route was a historical carriageway and that bridleway rights should be recorded.

A site inspection had been carried out on 24^th November 2016.

It was suggested that the limited equestrian use evidenced in this matter was not sufficient evidence of use from which dedication of a bridleway could be deemed just from that use, and there was no other evidence of a historical or long-standing bridleway use.

Taking all the evidence into account, it was suggested that the evidence was insufficient to satisfy the criteria of S31, nor sufficient from which to infer landowners' intention to dedicate a bridleway in this matter.

Resolved:  That the application to record a bridleway from Burnley Road to Antley Gate, Trawden, Pendle, in accordance with File no. 804-581, be not accepted.

A report was presented on the proposed diversion of part of Staining Footpath 6, Fylde Borough.

The Chair welcomed David Graham, Head of Service for Special Educational Needs and Disabilities (SEND), to the meeting. The report presented provided an opportunity to review the Short plan and the work completed on the Sufficiency and Suitability of Special Schools and Short Stay Schools in Lancashire.

The Department of Education (DfE) had conditionally allocated the county council funding to increase school places for people aged 0-25 with an Education, Health and Care (EHC) plan.

It was pointed out that the school population was rising. The number of children and young people with either a statement or Education, Health and Care Plan had also increased. The figure for Lancashire was significantly higher than the national average in terms of numbers and referrals. There was pressure on supporting school's funding for high needs. Two primary areas of need to focus on were children with Autistic Spectrum Disorder (ASD) and children with Social, Emotional and Mental Health.

It was reported that populations within the special schools was high and more capacity was needed. In order to improve the capacity, capital funding needed to be improved to increase the numbers that could be taken and look at alternative buildings that could be used.

Members were informed that the increase in numbers of children requiring special needs in Lancashire reflected the national increase which could have been contributed to as a result of the awareness raising of children with mental health issues. These issues were looking to be addressed not only in SEND schools but also mainstream schools.

It was confirmed that the SEND team had completed the Suitability Audit, which had meant sending surveyors into all the specialist schools and short stay schools. The next phase was to consult with families and schools in order to understand what they wanted regarding the overall programme the Authority was required to do.

The committee was informed that the majority of specialist placements were within Lancashire.  There were very few commissioned placements outside of the county apart from visual impaired, hearing impaired and looked after placements.

Regarding proposals to meet needs, members were informed that in north Lancashire there was currently not a specialist school for children with Social Emotional Mental Health (SEMH) issues. Proposals were being formulated address this current provision gap.

The SEND team was working with Property Management and Facilities Management and was utilising buildings that had become vacant near to or adjacent to specialist schools. In terms of staffing, within the specialist teacher service, the team was looking at where it had people with the specialist training that was required.

The practice and policy of the SEND team was that it always looked at the nearest suitable school for children with SEN issues then it was the preference of the parents.

Resolved: That the report presented be noted.

County Councillor Shaun Turner the Cabinet Member for Health and Wellbeing considered and approved a reduced Local Member Grant of £300 to Garstang and District Society to set up a poppy trail.

The reason for the reduction is that Councillor Turner has other grants to consider with limited resources available.

County Councillor Erica Lewis considered and approved a reduced Local Member Grant of £93.10 to St John's Hospice towards the Dementia Carers Course.

The reason for the reduction is that Councillor Lewis wanted to allocate her funds equally between the remaining groups. 

County Councillor Jayne Rear considered and approved a local member grant of £212.85 to British Lung Foundation Breathe Easy Chorley and South Ribble towards an easel, writing board, projector and screen and two health monitoring displays.

County Councillor George Wilkins considered and rejected a Local Member Grant of £397.80 to Caritas Care for a LCD touchscreen whiteboard display.

The reason or the rejection is that Councillor Wilkins cannot see any direct value to the residents of Preston Rural and he does not think the Local Member Grant scheme was designed for International charities.

County Councillor Geoff Driver, the Leader of the County Council considered and refused a Local Member Grant of £397.80 to Caritas Care for a LCD Touchscreen whiteboard display.

The reason for the rejection is that Councillor Driver does not feel there is little likelihood that they will raise the rest of the money given that there are only 3 CCs with funds.

County Councillor Erica Lewis considered and approved a reduced Local Member Grant of £93.10 to North Lancashire Wildlife Group towards bat detectors and field sampling equipment.

The reason for the reduction is that Councillor Lewis wanted to allocate her funds equally between the remaining groups.

County Councillor Jean Parr  considered and approved a reduced Local Member Grant of £100 to North Lancashire Wildlife Group for bat detectors and field sampling equipment.

The reason for the reduction is that Councillor Parr has other applications she wishes to support with limited funding remaining.

County Councillor Shaun Turner the Cabinet Member for Health and Wellbing considered and approved a reduced Local Member Grant of £99.67 to North Lancashire Wildlife Group.

The reason for the reduction is that this is the amount Councillor Turner has remaining in his budget.

The reason for the reduction is that Councillor Parr has other applications she wishes to support with limited funding remaining.

County Councillor Jayne Rear considered and approved a Local Member Grant of £1,000 to Flic Flac Gymnastics Club towards new kit and competition entry fees.

County Councillor David Foxcroft considered and rejected a Local Member Grant of £742 to Rossendale Radio to build and equip two studios.

The reason for the rejection is that Councillor Foxcroft has no funds remaining in his budget.

County Councillor Anne Cheetham considered and approved a reduced Local Member Grant of £ 200 to Rossendale Radio to build and equip two studios with the proviso that if the scheme does not materialised that the grant is reimbursed.

The reason for the reduction is that Councillor Cheetham has limited funds available in her budget. 

County Councillor George Wilkins considered and refused a Local Member Grant of £200 to Headway Preston and Chorley towards their supervised walks.

The reason for the rejection is that Councillor Wilkins does not feel the application has a direct benefit to the residents of Preston Rural and he does not grant money if there are paid employees.

County Councillor Jayne Rear considered and rejected a Local Member Grant to Higher Walton PTFA towards the cost of an outdoor reflection room.

The reason for this rejection is that it would not benefit people in the division of Leyland South.

County Councillor Jayne Rear considered and approved a Local Member Grant of £228.00 to Preston Multiple Sclerosis Society towards the cost of running an information event.

County Councillor David Stansfield considered and rejected a Local Member Grant of £742 to Rossendale Radio to equip two required studios.

The reason for the rejection is that Councillor Stansfield has no funds remaining in his budget.

Resolved: That the press and public be excluded from the meeting during consideration of the following items of business on the grounds that there would be a likely disclosure of exempt information as defined in the appropriate paragraph of Part 1 of Schedule 12A to the Local Government Act, 1972, as indicated against the heading of each item. It is considered that in all the circumstances the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

It was noted that the next scheduled meeting would be held on the 8^th June 2018 at 10.30am (preceded by the usual 30 minute briefing) in Committee Room 'C' - The Duke of Lancaster Room at County Hall, Preston.

It was also reported that after consulting members of the Committee arrangements had been made for an additional meeting to be held at 10.00am on the 5^th July, 2018, in Committee Room 'C' - The Duke of Lancaster Room at County Hall, Preston to consider the LCPF accounts.

County Councillor Nikki Hennessy considered and rejected a Local Member Grant of £100 to Sporting Challenge towards their weekend activities.

The reason for the rejection is that she has already supported this group and she wishes to distribute her funds to groups that have not benefited this year.

County Councillor Shaun Turner, the Cabinet Member for Health & Wellbeing considered and approved a Local Member Grant of £400 to Garstang School of Gymnastics for matting for mens parallel bars.

County Councillor Miles Parkinson considered and approved a Local Member Grant of £200 to Hyndburn Over 50's Forum towards the hire of the venue.

The Chair welcomed John Readman, Interim Executive Director of Education and Children's Services; Debbie Duffell, Head of Children and Family Wellbeing Service; Grant Murdoch, Subject Matter Expert (Children) Programme Office; Victoria Gent, Head of Service Children's Social Care – East; Halima Sadia, Social Worker; Lisa Sowden, Children Social Care Team Manager - East; and Wenda Tyrer, WPEH Team Leader, Children and Family Wellbeing Service – Lancaster District; to the meeting.

The report presented highlighted the key findings of a range of inspections that had taken place in Children's Services in the last year. It gave an overview of strengths and areas of developments. It also delineated governance structures and plans in place to support effective improvement going forward.

Since February 2017 there had been 13 different external inspections or reviews of Children's Services. There had been 4 monitoring visits by Ofsted, 2 looking at services for children looked after, 1 at Children in Need and 1 looking at the multi-agency safeguarding hub arrangements.

The Committee was informed that from April 2017 to February 2018 the Children and Family Wellbeing Service had supported 5,087 families made up of around 15,417 children and young people. Children's Social Care dealt with 1,908 Children in Need, 1,314 children subject to a child protection plan, and 1,949 Children Looked After. Also there was around 90 children open to the leaving care service. Other key service areas were the Fostering Adoption Residential Service, the Youth Offending Service, and the Special Educational Needs and Disabilities Service.

Regarding rural areas Members Were informed that the Children and Family Wellbeing resources were deployed around all districts in the County including the rural areas. There was also an outreach model for rural areas. The Team also worked very closely with colleagues in Children's Social Care and was looking to integrate those resources.

It was reported that there were ongoing challenges around recruitment and retention of social workers. Campaigns were in place around recruitment and was definitely improving. It was confirmed that a robust recruitment and retention strategy was in place in Children's Social Care. Regarding retention of children's social workers, the average length of retention fluctuated across the County. It was highlighted that there was a number of support mechanisms in place for retention of staff and advanced practitioners in place to work alongside staff on more complex issues.

After feedback from Ofsted the Committee was informed that police referrals were still very high. The Police were working closely with LCC around their part in child protection.

On the Improvement Plan it was noted that one of the areas, 'to develop and implement a delivery plan for the Residential Strategy and edge of care response', was delayed in its progress due to delays in building works. At its March meeting Cabinet approved additional capital investment to complete the building works.

Members were informed that the next Ofsted inspection would be a four week full inspection potentially sometime between May 2018 and July 2018.

It was acknowledged that the quality of work had improved and this was having a positive impact on the children. Also work with Education had improved greatly.

The High Needs Block (HNB) of the Dedicated Schools Grant (DSG) which funds Special Education within Lancashire Schools and Academies for the financial year 2018/19 is forecast to overspend by circa. £8.5m. The report approved by Cabinet on 18 January 2018 entitled "School Budget 2018/19" balanced this funding gap through the use of DSG reserves but also noted that a review was underway to move quickly to a position where forecast expenditure was in line with the available budget.

This report sets out the financial situation, the reason action is required now, the measures being adopted and ratified by School Forum, and the mitigating actions that are being undertaken.

Reason for Urgency

This decision is urgent and cannot await the next meeting of Cabinet on 12 April 2018. The reason for this is that in order for these measures to be enacted they must be included within Individual School Budgets which are issued on 9 March 2018. On 18 January 2018 Cabinet approved the apportionment of anticipated 2018/19 main highway and transport grant funding from the Department for Transport (DfT). The Department for Transport (DfT) Challenge Fund and the £5m county council Invest to Save schemes are nearing completion and collectively have enabled 87,000 light emitting diode (LED) lanterns to be installed and approximately £3.4m saved from the street lighting energy revenue budget since 2014/15.

Following discussions with Salix Finance Ltd, a government funded body that provides interest-free funding to the public sector to improve energy efficiency, reduce carbon emissions and lower energy bills, a proposal has now been developed to enable the street lighting energy efficiency programme to be completed.  The proposal as detailed in the report meets Salix funding requirements and would enable a further 38,000 street lighting lanterns to be replaced with LED equivalents. It is anticipated the proposal will cost in the region of £9.200m, which would be funded by an interest free loan and enable a further £1.843m to be saved recurrently from the street lighting energy revenue budget per year when complete.

A scheme to improve cycling provision in the Westgate /Railway Road area of Skelmersdale is included in the 2016-17 Road Safety Programme. The scheme will provide a safe, off-road route between the residential neighbourhoods of Skelmersdale, north of Railway Road, to the Gladden Place employment area.

South of Railway Road, the route involves widening an existing footway and converting it to a shared footway/cycle track, the remaining part of the route requires construction of new cycle track, north of Railway Road to Waldron.

To enable a cycle track of suitable width to be constructed, a small area of verge at the junction of Westgate and Waldron needs to be adopted by Lancashire County Council and agreement has been reached with the land owner, West Lancashire Borough Council to undertake this.

The County Council has a Premises Use Policy and associated procedures to be followed when considering the use of County Council premises by external organisations.

The policy and procedures are due for review following changes to the use and retention of County Council's premises which has seen an increase in the level of co-location of services, centrally managed operational buildings, and premises costs. The policy sets out how premises can accommodate use by different types of community organisations e.g. Friends of Library groups whilst adhering to good premises management practice. The County Council continues to support the use of its premises by external organisations for educational, community and service-delivery purposes. The focus is to allow community use of buildings that complements County Council service delivery and supports the strategic objectives of the authority. The charges for sessional use/hire have been increased in line with the change to the retail price index and are included as part of the Premises Use Policy at Appendix 'A'.

The Department for Transport is consulting on proposals for the creation of a Major Road Network (MRN).  Funding for improvements on the MRN will be available through the Government's new National Roads Fund from April 2020.  Subject to a few minor reservations, the County Council is broadly supportive of the approaches proposed for defining the MRN and developing a programme of investment.  This report summarises the Government's proposals and the rationale for the County Council's proposed response, which is set out in Appendix 'A'.  It also identifies locations on the indicative MRN in Lancashire that could benefit from this initiative.
