Adding a Scheme to the Capital Programme
Following successful design and delivery of the traffic calming
scheme in Woodplumpton and design of the scheme in Catforth, we
have agreed with Woodplumpton Parish Council to delivery a traffic
calming scheme for the village of Catforth. The fee agreed is
£376,204.45

Legislative changes came into effect on 6 April 2024 requiring updates to a number of employment policies and procedures, and the introduction of a new carer' leave policy and procedure, to ensure compliance. The changes are set out below:
Working flexibly policy and procedure:
(1) Flexible working requests are a day one right.
(2) Two requests for flexible working can be made within any
12-month period.
(3) A final decision (including appeal) needs to be made within two
months (was previously three months).
Carer's leave policy:
(1) A new policy that has been introduced to reflect the statutory
right for employees with caring responsibilities to take one week's
unpaid leave per year (subject to qualifying criteria).
Working carers policy:
(1) Updated to include reference to the Carers Leave Act 2023 that
gives employees with caring responsibilities a statutory right to
take up to one week's unpaid leave per year (subject to qualifying
criteria) to give or arrange care for a dependant.
Redundancy procedure and priority access to vacancies policy and
procedure:
(1) Updated to reflect extended redundancy protection for pregnant
women, women on maternity leave (or have suffered a miscarriage),
and employees on adoption leave and shared parental leave for up to
18 months from the expected week of childbirth (subject to various
criteria).
Paternity leave policy:
(1) Paternity leave can now be taken as two one-week
non-consecutive blocks at any point in the first year following
birth.
(2) The notice for paternity leave has been reduced to four weeks
and leave dates can be varied with 28 days' notice.
The revised policies and procedures have been shared with the
recognised trade unions at the Joint Negotiating and Consultative
Forum and the changes to these have been noted.

It has been highlighted from a financial standpoint that there is a shortfall within the available budget for an external contractor's imbursement. The historic payments and transfers against the current PPMS ID are under review to accurately reflect available budget and the developers future payments, whilst this investigation is ongoing a decision is required for temporarily borrowing funds against the scheme until the developer pays over the next calculated stage instalment.
This borrowing of funds will allow the payment for the pending
invoice covering site investigation measures to date, the sum
amounts to £2,844.69 and is inclusive of internal staff
charges.
Due to the financial structure of the agreement in place with the
developer there is no potential for loss of revenue to Lancashire
County Council.

The authority is seeking to procure a specialist property auctioneer to assist in the disposal of authority properties no longer required by the authority.
The provider will be capable of assessing the suitability of vacant properties for auction, advising on reserve and guide prices, conducting viewings with prospective purchasers, and marketing the property before ultimately auctioning the property and negotiation of post auction sales as required.
It is estimated that approximately 10-20 properties are required to be sold via auction per annum but this, as well as the value of property being auctioned, can vary significantly each year.
The procurement is a renewal of a long-existing rolling agreement, managed by the authority's Estates department. The intention is to contract with a single provider on a framework basis for an initial term of two years, with the option to extend the term for any number of defined periods up to a maximum of a further two years.
The authority will not be charged a fee by the provider for provision of the services. Instead, the fee will be paid for by the buyer of the property following sale.

Approval is sought for the County Council to
enter into an agreement under Section 106 of the Town and Country
Planning Act 1990, for an obligation for the developer to pay a sum
of £512,416.00 to mitigate the impact of the development and
make it acceptable in Highways and transport terms.
When consulted by Lancaster City Council on a planning application
for the erection of to 70 dwellings with public open space and
associated infrastructure and creation of a new access, the Local
Highway Authority recommend approval of the proposed development
subject to suitable mitigation being provided. However, Lancaster
City Council's Planning Committee refused the application on
multiple grounds, and this was appealed by the applicant. The
Appeal Reference for this site is APP/A2335/W/23/3335117 and the
Public Inquiry will commence on Tuesday 16th April 2024. Highways
and Transport has now been overcome as a matter of dispute
following further work undertaken by the applicant and the
provision of the agreed highways mitigation.

A report was presented on an application for the diversion of part of Footpaths FP0921004 at Brinscall Hall Barns, Wheelton.
The recorded alignment of this section of the footpath was from the pasture to the south of Brinscall Hall Barns in a north-north-easterly direction, through the grounds of the residential property of 4 The Shippon, to the access track to the north of 4 The Shippon. It was proposed that the footpath be diverted slightly away from the boundary wall of Brinscall Hall Barns, to continue in a broadly northerly direction to a point in the pasture to the west of the grounds of 4 The Shippon, to continue parallel to the boundary of the property to cross the access track and then continue on the existing line to Harbour Lane near Harbour Farm.
The length of existing path to be diverted was shown by a bold continuous line on the Committee plan attached to the agenda papers and marked A-B and the proposed alternative route was shown by a bold broken line and marked A-C-D.
The consultation with the statutory undertakers had been carried out and no objections or adverse comments on the proposal had been received.
The Officer answered questions from Committee.
After a discussion, it was Proposed and Seconded:
"That the Recommendations in the report be approved, subject to an additional Recommendation stating that the applicant be required to stone the route from C-D, and that the path be built up to a level around the tree at point C and before the Order is confirmed"
Resolved:
(i) That an Order be made under Section 119 of the Highways Act 1980 to divert part of Footpaths FP0921004 from the route shown by a bold continuous line and marked A-B to the route shown by a bold broken line and marked A-C-D on the attached map.
(ii) That in the event of no objections being received, the Order be confirmed and in the event of objections being received and not withdrawn, the Order be sent to the Secretary of State for the Environment, Food and Rural Affairs and the Authority take a neutral stance with respect to its confirmation.

A report was presented on an application for the addition of a footpath from Main Street to Home Farm Close to the Definitive Map and Statement of Public Rights of Way, as shown on the Committee Plan attached to the agenda papers between points A-B-C-D-E.
Committee were informed that Home Farm had been incorrectly spelt as 'Holme Farm' on the first 2 pages of the report. In addition, on the fifth line of the third paragraph on page 147, the word 'dedication' should have read 'declaration'.
A site inspection had been carried out in March 2023.
Various maps, plans and other documents had been examined to discover when the route came into being, and to try to determine what its status may be.
Taking all the information and evidence into account, it was suggested to Committee that, given the use of the route from 1984-2004 without effective interruption, and without sufficient evidence of actions taken by the owner, there was sufficient evidence from which to reasonably allege that a footpath had come into being and that an Order be made. It was advised that this matter would then be returned to Committee to decide on the stance for confirmation.
The Officer answered questions from Committee and clarified the process in relation to Recommendation (iii) in the Committee report.
Resolved:
(i) That the application for the addition to the Definitive Map and Statement of Public Rights of Way of a Footpath from Main Street to Home Farm Close, Wray with Botton be accepted.
(ii) That an Order(s) be made pursuant to Section 53 (2)(b) and Section 53 (3)(b) and/or Section 53 (3)(c)(i) of the Wildlife and Countryside Act 1981 to add to the Definitive Map and Statement of Public Rights of Way a Footpath from Main Street to Home Farm Close as shown on the Committee Plan between points A-B-C-D-E.
(iii) That not being satisfied that the higher test for confirmation can be met following the order making and notice period and further consideration by officers the matter be returned to Committee to decide what stance to take regarding confirmation.

A report was presented on an application for the diversion of part of Footpath FP0706024 at Station Road, Little Hoole.
The recorded alignment of the section of the footpath from just south of the end of Station Road to approximately 500m north of the road was along the track. It was proposed that the footpath be diverted from the track and onto a path to be created by Natural England along the western verge, where they intend to realign the England Coast Path. To the south of Station Road, the current alignment passed through a hedge and it was proposed to divert the last 40m along the field edge and install a kissing gate leading across the tarmac turning head to a further kissing gate into the field to the north.
The length of existing path to be diverted was shown by a bold continuous line on the Committee plan attached to the agenda papers marked A-B, excluding section X-Y across Station Road, and the proposed alternative route was shown by a bold broken line and marked A-E-Z-C-D-B.
The consultation with the statutory undertakers had been carried out and no objections or adverse comments on the proposal had been received.
Resolved:

The legal officer read out a summary of a written objection which had been received late afternoon on 23rd January from solicitors representing Bloor Homes.

Committee were informed that the historical evidence showed that A-X-B-C-D was a significant bounded route, marked on old maps as a crossroad which indicated it would have been capable of being used by horses. Even though the route seemed to have fallen into disuse, Committee needed to take the evidence into account and consider whether the route was historically a bridleway.
In conclusion, taking all the evidence into account, Committee were advised that, on balance, inferred dedication of public bridleway rights under common law could be satisfied for section A-D and public footpath rights under common law could be satisfied for section B-E. Committee were therefore recommended to accept the application.
Resolved:
(i) That the application for the addition to the Definitive Map and Statement of Public Rights of Way of a Footpath from Blackpool Road to the Preston Guild Wheel Cycle Route with a link to/from North Syke Avenue be accepted.

A site inspection had taken place in April 2022.
This application had been submitted based on 'modern' user evidence and the route did not appear to have come into existence until a bridge had been erected across Colne Water, as shown between point A and point B on the Committee plan. Land Registry information suggested that the bridge had been erected sometime after 1971 and no maps or photographs inspected prior to that time showed the bridge.
For this reason, maps and documents predating the 1970s – whilst having been checked by the Investigating Officer – had not been included in the report, as the route could not have existed until access was available across Colne Water and there was no evidence to suggest that, before that time, a different route to/from Cotton Tree Lane had been used.
In conclusion, taking all the evidence into account, the Committee were informed that they may, on balance, consider that the provisions of Section 31 of the Highways Act 1980 could be satisfied. Committee were also advised that they may consider it could be reasonably alleged that there was sufficient evidence from which to infer dedication of a public footpath at common law.
Committee were asked to consider whether they were satisfied that there was sufficient evidence from which to infer dedication and, if so, to make the Order as set out within the Recommendation in the Committee report.

Brabin's Endowed School is a small, rural primary school, with a relatively small school field backing onto open agricultural land. The footpath currently runs between the walled perimeter of the school and the neighbouring residential property, then out across the centre of the school field to the far boundary, then out through a gate and across a pasture then along a residential access road. There was also another branch along most of the length of the pasture.
The lengths of path to be diverted were shown on the Committee plan attached to the agenda papers as a bold continuous line marked A-F-G-H-D and F-E, and the proposed new footpath was shown by a bold broken line marked as A-B-C-D and C-G-E.
Committee noted that, if successful, the diversion would move the footpath away from the centre of the school field, and onto the edge of adjacent land that was part of St. Mary's Roman Catholic Primary School, with their consent. This would increase the security and safeguarding for pupils and staff, whilst providing a route that was safe and convenient for public use. The diversion would also cross the pasture around the edges of the field which was more efficient for agriculture.
The consultation with the statutory undertakers had been carried out and no objections or adverse comments on the proposal had been received.

Committee were advised that the claimed route had been shown since circa 1845 on numerous maps, and that it connected to a network of other public highways. The evidence presented in the maps was consistent with a way that carried at least a public bridleway. However, there was less convincing evidence, on balance, as to whether public vehicular rights existed.
Given the nature and amount of the evidence, it was advised that the evidence of the application route having become a public bridleway was sufficient and that Committee may conclude, applying the relevant tests, that it could be concluded that a bridleway “subsists".

A summary of the current progress on all Definitive Map Modification Order and Public Path Order applications was provided, including an update on those matters which had progressed since last year's report. This data had been extracted from the statutory register on 4th January 2024.
It was noted that although the term 'applications' had been used for convenience, these were not all formal applications made under Schedule 14 of the Wildlife and Countryside Act 1981 for definitive map modification orders, but included some cases where sufficient evidence had been discovered or presented to the county council to indicate an investigation was appropriate. For public path orders, there was currently no statutory application process but the list included requests using Lancashire County Council's application form or otherwise, and also cases where it appeared to officers that a Public Path Order was appropriate.

Committee were advised that the fact that part of the application route was not presently recorded did not mean that it did not carry public rights of way as disuse of a route did not take away the public rights. As there had been no legal stopping up of those rights, it was advised that the legal maxim "once a highway always a highway" applied.
Committee were informed that, if they were content that there was sufficient evidence of an old vehicular highway between point B-D, the Natural Environment and Rural Communities Act 2006 would have extinguished mechanically propelled vehicular rights, leaving the route to be appropriately recorded as a restricted byway.

Public Path Dedication Agreement to create a Bridleway over The Old

A report was presented on the proposed creation by agreement of a publicly maintainable bridleway across the Old Tram Bridge and any replacement bridge on the same line providing access to and from Avenham Park, Preston.The length to be dedicated as bridleway was shown on the Committee plan attached to the agenda papers between points U-V-W-X-Y.
It was reported that Old Tram Bridge (the Bridge) was owned by Preston City Council, having been acquired by its predecessor, Preston Corporation on 17 July 1872, when Avenham Park and Miller Park were being completed. The Bridge was currently unsafe and required demolition and replacement. It was temporarily closed by virtue of a temporary traffic regulation order.
Preston City Council had obtained funding for a scheme to deliver the demolition of the Bridge and the construction of its replacement on the same line, although at a higher level. Both Lancashire County Council and Preston City Council were keen to secure that outcome. The funding provided was allocated on the basis that the scheme did not require a Compulsory Purchase Order and access to carry out the work also relied on the county council having a power to maintain the bridleway. It was therefore proposed to enter into a public path creation agreement under Section 25 Highways Act 1980 for a new bridleway maintainable at public expense, which would formalise the public rights and maintainability of the surface.
By entering into an agreement, this would impose a statutory duty of maintenance on Lancashire County Council in relation to the surface of the bridleway carried by the present Bridge and its replacement. The main terms of this agreement were set out in the Committee report and Committee noted the right for the owner to raise the level of the highway, albeit the structure itself would remain in the ownership and responsibility of Preston City Council.
A draft agreement was being considered by Lancashire County Council and Preston City Council which dealt with all the main terms, and was only intended to be completed once funding was confirmed, and other agreements were also able to be completed. Preston City Council had confirmed that they were content with the main terms of the agreement and would work to finalise the wording.

Resolved:
(i) That the proposal to dedicate a bridleway over the Old Tram Bridge and any replacement bridge on the same line crossing the River Ribble along the approach ramp at the north end of the bridge to bottom of the ramp on the south end and down the slope towards the river, as shown on the plan attached as U-Y, be accepted on the main terms as set out in the report.
(ii) That the Director of Environment and Planning be authorised to finalise and enter into a Public Path Creation Agreement under Section 25 of the Highways Act 1980 between Preston City Council, as the owner of the Old Tram Bridge and its replacement, and Lancashire County Council, with completion at a time and to include wording in accordance with the main terms as set out in the report to dedicate a length of bridleway marked by a bold dashed line on the attached map and annotated U-Y.
(iii) That Committee note the recording of bridleway (BW0602072) on the Definitive Map and the making of an Order in 2003 to record bridleway rights over part of the route, but both are believed to have been in error. Officers will take any appropriate action to resolve these issues in due course.

The Principal Planner presented a Powerpoint presentation showing a site location plan, aerial views of the site, the current approved final restoration and remaining mineral reserves. Also shown were photographs of the site, the remaining reserve area, site entrance, Slaidburn Road heading down to Waddington, Waddington village, Slaidburn Road at the top of Waddington Fell, Slaidburn Road heading towards Newton and Hallgate Hill rising up from Newton.
Mr Chris Sullivan, local resident, addressed the Committee. Mr Sullivan made it clear that his observations had been made prior to becoming a Parish Councillor and that his views were not being presented on behalf of the Parish Council. Mr Sullivan said the following:
''I live on Clitheroe Road which is the main route for vehicles in and out of the quarry. I was rather hoping by the end of 2022 that vehicles would have stopped. Clearly that extension was granted for a year. Because of the link between the quarry and the arisings from the HARP (Haweswater Aqueduct Resilience Programme) project, we've rather got a Hobson's choice in Waddington, which is without the quarry as a receptacle for all the arisings, we would have a village through which large numbers of vehicles would have to pass.
The thing that I want to discuss today are the absolute fine detail of the timings of HARP. Sadly, over the last few years I've become a little bit of an anorak as far as the traffic management plan is concerned with HARP. And just to let everybody know that during the first 12 to 18 months of HARP, there will be vehicles using both Clitheroe Road and West Bradford Road to construct the river crossings over the River Ribble and over the Hodder at Newton. This will not involve vehicles with any arisings, because that can't take place until the construction camps are in place and those crossings are in place across the Ribble.
This proposal proposes that there will be vehicles leaving the quarry with minerals heading for Hanson Cement, and the shortest route to Hanson Cement is via West Bradford Road, which goes past the school with all its complications around traffic, and what I am proposing is that any link to the HARP scheme will be linked to the commencement of HARP, not to the commencement of the arisings from the tunnelling - and that's for a good reason. The traffic management plan, which has been proposed but not as yet accepted by highways, assumed there will be no outflow of minerals from the quarry, so what it could do is render that traffic management plan inaccurate.
So my request today is that what you do is link the planning permission to the start of the HARP programme, not the period from which they start taking arisings because there will be 18 months of large vehicles with machinery to affect those river crossings at Newton and at Waddington.'
It was reported that United Utilities had suggested the HARP scheme would not commence until late 2025 or early 2026. On that basis, Committee were informed they may consider it reasonable to amend condition 1 and, instead of tying it to the first deposit of aqueduct arisings, make this prior to the commencement of the HARP scheme. Committee noted that the latest end date for quarry operations was 1st July 2026, which could be brought forward with this condition, if required. It was considered that this amendment would give residents more assurance that quarrying activities would stop prior to construction vehicles activity.

'That the application be approved, subject to condition 1 being amended to reflect that the mining operations cease prior to the commencement of development of works associated with the Haweswater Aqueduct Resilience Programme.'

Lancashire County Council and Merseyrail with the support of the Liverpool City Region Combined Authority have developed a multi-modal ticketing agreement to retail combined bus and rail tickets as part of the wider Skelmersdale TrainLink project.
The Skelmersdale TrainLink service began on 22nd January 2023 with bus services (service number 319) operating between Skelmersdale Concourse and Kirkby Bus Station via Kirkby Railway Station. The TrainLink bus service is operated by Stagecoach under contract to Lancashire County Council using funding provided by Central Government's Bus Service Improvement Plan.
An agreement has been developed which specifies the arrangements of the bus / rail multi-ticketing arrangements to be retailed on the Skelmersdale TrainLink bus service and on the Merseyrail network.
This report considers the options available to Lancashire County Council, provides a recommendation and approves the approach to be taken.
Detail
The Skelmersdale TrainLink service began on 22nd January 2023 with bus services (service number 319) running between Skelmersdale Concourse and Kirkby Bus Station via Kirkby Railway Station. The 319 bus service is operated by Stagecoach under contract to Lancashire County Council using funding provided by Central Government's Bus Service Improvement Plan.
It is proposed that Lancashire County Council introduces bus / rail multi-modal ticketing products on the Skelmersdale TrainLink service in partnership with Merseyrail and with the support of the Liverpool City Region Combined Authority.
Lancashire County Council will be the "administrator" of the ticketing scheme, with recording of sales, reconciliation and reimbursement and the provision of information.
It is intended that the scheme commences in May 2024, operating as an integral part of the Skelmersdale TrainLink service and being subject to regular review by scheme partners.
Consultations
Extensive consultation on the Skelmersdale TrainLink project has taken place between Officers of Lancashire County Council, Merseyrail, Liverpool City Region Combined Authority and Stagecoach. The Cabinet Member for Highways and Transport has been kept up to date with progress relating to agreements, the programme for implementation and ongoing review.

Financial
The Skelmersdale TrainLink project is funded via the Lancashire County Council Bus Services Improvement Plan. The revenue risk of the multi-modal ticketing introduction is minimal and there are no financial implications arising directly from this report.
Price setting of multi-modal ticketing products is subject to regular review and will be undertaken with the consensus of scheme partners. Each scheme partner may withdraw from the scheme on giving not less than 28 days prior notice in writing.
Procurement
The Skelmersdale TrainLink bus service is provided under contract to Lancashire County Council. There are no procurement implications arising directly from this report.
Legal
The multi-modal ticketing scheme is intended to operate as a voluntary scheme and not as an advanced ticketing scheme pursuant to section 134C to 134G of the Transport Act 2000. The Scheme Partners intend for this Agreement to comply with the terms of the Competition Act 1998 (Public Transport Ticketing Scheme Block Exemption) Order 2001 as amended by The Competition Act 1998 (Public Transport Ticketing Schemes Block Exemption) (Amendment) Order 2016 (the "Block Exemption").

The capital funding will be made available to private, voluntary, and independent childcare providers, childminders and schools to create new places or expand existing provision in priority areas across Lancashire where there is a need for additional places.

In January 2024, Cabinet approved the commencement of a statutory consultation regarding a proposal to permanently expand Archbishop Temple Church of England High School, Preston, from September 2025, by increasing the school's Published Admission Number from 155 to 210. The enlargement proposal forms part of Lancashire County Council's School Place Planning Delivery Programme 2023 to 2025, approved by Cabinet in October 2022. The Chair welcomed to the meeting County Councillor Aidy Riggott, Cabinet Member for Economic Development and Growth, Andy Walker, Head of Service Business Growth, and Steve Burns, Head of Service Strategic Development.
The committee was presented a report on the county council's contribution towards the £12.8m Lancashire Economic Recovery and Growth programme towards post-Covid 19 economic recovery. The report also provided information on the pan-Lancashire Aerospace Watchtower Growth Accelerator project as a case study.
A presentation was provided during the meeting, and a copy can be found within the minutes.
Comments and questions raised by the committee were as follows:
· Some of the challenges the area faced was the ability of manufacturers to effectively use digital technologies they had. For instance, some companies would purchase an Enterprise Management System with considerable capabilities, but they might only use it for managing the financial and logistics elements. What some of this work had found was that these companies could put relatively low cost monitoring systems on machining equipment, to help with productivity gains. In addition, it was highlighted that repair and maintenance schedules should also be put in place to minimise unforeseen outages.
· It was noted that for Lancashire the evidence was suggesting that digital wasn't displacing jobs but complementing them. Businesses were not reducing jobs but using digital to supplement the work and processes.
· The concept of how cyber interacted with the physical world would be an important factor for the Lancashire area. It was felt this could be an opportunity for the area to lead on this sector nationally and potentially worldwide.
· The £12.8 million Lancashire Economic Recovery and Growth (LERG) fund was approved by Cabinet in September 2021. Whilst some funding was still available, officers were reassessing budget positions before allocating funds towards additional projects due to an increase in costs. Further conversations with District Councils were expected to take place to establish the most effective way to allocate funding.
· On the £5m additional Levelling Up Fund, £1m of match funding was offered to those district councils who could evidence £2 million of local match funding (Tier 1) and £500,000 offered to successful Tier 2 bids. With funds remaining, it was reported some district councils were reviewing some of their plans.
· It was noted that the Growth Accelerator Programme was a sector intelligence led steering group and did not necessarily include companies who were looking to benefit from the programme itself. The group provided an opportunity to share high level intelligence with companies further down the supply chain to deliver programmes around innovation and diversification.
· It was confirmed that officers would carry out checks with those companies who had received interventions to check they had sustained any employment increases. Officers explained that engagement could continue with businesses and organisations involved in the Growth Accelerator Programme with repeat audits taking place on a revolving 6 month cycle up to 2 years after the awarding of funds to analyse the company's increase in productivity, sales and exports.
· It was highlighted that Apprenticeship Grants were delivered through the Skills Hub Team, with companies offered a small financial incentive to take on new apprentices. Whilst the apprenticeship levy was available to larger organisations such as the county council. It was reported that there had been some efforts in Lancashire to pool levy where it had not been spent and for this to be deployed within supply chains. Apprenticeship Grants was a more discrete programme that helped businesses with adaptations and provided assistance to apprentices with equipment or uniform that would be needed to fulfil their role. The targeting of this programme was aimed at those companies who had not taken on an apprentice for the last two years or hadn't taken on any at all.
· On whether the visitor economy had improved as a direct result of grants being awarded, the committee was informed that Marketing Lancashire had an established methodology in place to measure the impact of grant funding within the tourism sector. This was based on the STEAM (Scarborough Tourism Economic Activity Monitor) tourism economic impact model which was designed to provide a structured framework to develop a wider range of tourism input data. Smaller grants used the methodology of the national and rural business funds and previously European rural business funds which track new customers as the principal measure, whilst measuring increases in turnover and employment.
· It was noted that in Lancashire, tourism had not quite reached the levels that were seen before the COVID-19 pandemic in 2020. Some of the rural tourism offer was still struggling to reach previous levels.
· On how funding would be utilised to invest in the continuing development of projects, it was clarified that the funding provided for newly commissioned projects was on the basis that the project would be credible and sustainable over time and enabled companies to develop a future business and funding plan.
· Officers commented that future investment into projects could be more aligned around the county council's economic, environment and transport strategies, with new funding for transport, regeneration and levelling up projects to be considered as well. Projects which had the best chance of success were those that could provide the best outcomes and value for money in terms of investment back into the county.
· With regard to the Aerospace Watchtower Programme, low carbon goods and services were areas for potential diversification and there was considerable synergy in terms of the skillset that was readily available that could be transferred into other companies. Collaboration with colleagues at East Lancashire Chamber of Commerce was underway to explore this further. However, there was no discrete project for this in terms of the programmes that were picked up by the LERG programme.
· Officers confirmed that there was significant support on offer for businesses looking to expand into the low carbon sector, an example was the programme from the Northwest Net Zero Hub which was effectively the Department for Energy Security and Net Zero (DESNZ) working on a regional basis providing funds and officers to work as part of the county council's Business Growth Team to encourage low carbon sector development.
· It was reported that the county council was at the point of making some grant awards for piloting new energy reduction activities within the business space in Lancashire. It was highlighted that there was additional officer resource focussing support around green finance for businesses transitioning towards low carbon technology.
· On ensuring that newly created jobs were not redeployed or reallocated from other areas, officers confirmed that there was an established methodology in place where a baseline was taken from businesses. Any jobs that were classed as at risk of redundancy were categorised as safeguarded, whilst any net additional jobs above this threshold were classed as newly created jobs.
· It was suggested that an update on Lancashire BOOST programme be added to the work programme.
Resolved: That, an update on the Boost programme, Lancashire's Business Growth Hub be considered for potential inclusion on the 2024/25 work programme at the next work programming session for the committee in June 2024.

The committee was presented a report which provided information on the Transport Asset Management Plan (TAMP) and how Lancashire County Council intended to manage highways assets efficiently and effectively. A presentation was provided during the meeting, and a copy can be found within the minutes.
On the duration taken for requests received from county councillors for work to be carried out under the Local Deterioration Fund, it was confirmed that all the data was analysed up to three times per year, with any requests that came through from the middle of the year being added onto the next tranche of LDF schemes. On the weightings/factors used to determine the prioritisation of work, it was reported that a document had been signed off by the former Cabinet Member for Highways and Transport which set out how the Capital Programme was allocated. A copy of the document would be circulated to the committee.
Comments and questions raised by the committee were as follows:
· It was confirmed that a summary of how the Transport Asset Management Plan (TAMP) operated would be provided on the Lancashire County Council website and on the Local Deterioration Fund (LDF).
· It was noted that approximately £40m worth of schemes had been submitted. With £15m of schemes costed up and an available budget of £4.6 million for the 2023-24 financial year to carry out repairs to road surfaces. It was clarified that the service did not have £15m in the budget to deliver those schemes in 2023/24.
· Officers highlighted that the reactive maintenance and repair works for highways assets was only available for smaller, localised repairs for the 2023-24 financial year. It was highlighted that they did not have the budget to commission repairs to larger patches. In these instances, officers were making requests via the LDF pot to carry out that work. However, officers were in the process of reviewing and trialling new methods for repairs to larger patches.
· Members of the committee felt disenfranchised with how reported highways defects were prioritised, and the TAMP appearing to be fully driven by a remote computer system. The ability for councillors to have some influence over this was not in place at Lancashire whereas other local authorities allocated around 80% through the modelling process and the remaining 20% driven by councillor engagement. Officers explained that with pothole repairs it was difficult to obtain member involvement, as this type of repair was done on a reactive basis. It was also explained that without using the TAMP process, the county council would have lost over £3m per year because the county council wouldn't have been following the well managed highways process and the requirements posed by the Department for Transport. A balance was needed and having member involvement could potentially lose that money because the county council might not be demonstrating that it was following good practice. Although, it was acknowledged the LDF perhaps provided some flexibility and a mechanism for councillor involvement in Lancashire.
· It was noted that schemes needed to be under 2000 square metres for consideration as part of the LDF. The prioritisation of schemes on the LDF did not relate to strategic importance and was based on accepted customer complaints and the number of repeat visits to potholes to help reduce the burden on revenue spend.
· It was confirmed that over a period of 7 years, an indicative allocation of £494m from the previously earmarked funding for HS2 could be given to Lancashire County Council. The allocation would be back loaded in that less funding would be given in the first two years, with more funding provided in the remaining five years. However, guidance was awaited on how much of this could be allocated to maintenance programmes. Once the guidance was received, there would be a requirement for the county council to submit a plan for the first two years of funding detailing how this would be distributed. At this stage the amount of funding to be provided in the first two years was not known.
· It was suggested that a review of the TAMP to determine if it's working effectively should take place.
· On footways it was acknowledged that the county council didn't achieve what it set out to do in Phase 1 of the TAMP. It was highlighted that further repairing of footways within Lancashire could only take place if additional funding and resources was made available.
· It was suggested that a decision making process would be beneficial for members when submitting requests through the Local Deterioration Fund.
· It was noted that 48% of repairs carried out on potholes across Lancashire were done within 10 days, with a variation in timescales for pothole repairs depending on the location and its depth. It was confirmed that potholes were sealed, however there were circumstances were this was not possible in areas where there was significant deterioration. It was acknowledged that there was a backlog of potholes that needed repairing following the winter period.
· It was suggested that more formal feedback be provided from Highways Officers following the conclusion of the quarterly District Briefing meetings involving members.
· Concerns were raised that the only way to report defects to the county council was through the Love Clean Streets App. However, it was queried whether an equality impact assessment had been undertaken prior to the roll out of the App. Whilst, officers were not aware of any policy change and agreed to check this point, it was suggested that an urgent review of the defect reporting system be conducted to confirm that there were other methods to report potholes including via the call centre.
· It was felt that clarification on the workings of the Transport Asset Management Plan (TAMP) and the Local Deterioration Fund (LDF) be provided to the committee.
· Some concern was expressed on how defects were being identified through the highway inspection process in that repeat visits had been made to particular locations whereupon second opinions eventually determined that work was actually required to resolve those matters. It wasn't clear if pothole depths were being estimated from a drive-by or whether officers were parking up and walking to physically inspect and measure given the number of cases one councillor had been involved with. It was suggested that a review of the highways safety inspection process be undertaken.
Resolved: That; the Cabinet Member for Highways and Transport gives consideration to;
(i) Conducting an urgent review of the defect reporting system and to confirm that there are other methods to report potholes via the call centre.
(ii) Providing clarification on the workings of the Transport Asset Management Plan (TAMP) and the Local Deterioration Fund (LDF) with a view to enhanced member engagement in the LDF.
(iii)Reviewing the highways safety inspection process.
