Key Decision definition: A key decision means an executive decision which is likely:
(a) to result in the council incurring expenditure which is, or the making of savings which are significant having regard to the council's budget for the service or function which the decision relates; or
(b) to be significant in terms of its effects on communities living or working in an area comprising two or more wards or electoral divisions in the area of the council.
For the purposes of (a) above, the threshold for "significant" is £2.2 million (from 1 April 2024).
The Care Act 2014 altered the financial, legal, commissioning and operational landscape for local authorities. Reviewing, maintaining and improving the county council's adult social care policies, procedures and guidance (PPG) is essential to the professional and high quality delivery of assessments, support, information and advice for those working with adults who have social care needs, and to ensure legal compliance with the Care Act.
A comprehensive review of the County Council's adult social care policies, procedures and guidance has therefore been undertaken and key policy documents have been identified for review and revision as part of a phased programme, as approved by the Cabinet Member for Adult and Community Services on 9 March 2016.
This phased programme continues with the submission of three policy, procedures and guidance documents: Independent Mental Capacity and Mental Health Advocacy, Assessment of Needs, and Review of Care and Support Plans.

An experimental traffic regulation order which created a bus lane westbound on Fishergate between Mount Street and Corporation Street and another bus lane eastbound between Butler Street and Corporation Street was introduced in October 2016 to manage the traffic congestion that occurred in the lead up to, and during the, festive period of 2016/17. The experimental order was subject to a 6 month consultation period and this report sets out the impacts of the bus lanes, the outcome of the consultation and proposals for managing traffic in Preston city centre.

The Chair welcomed Vanessa Carthy, Programme Relationship ManagerLearning and Development; and Suzanne Ward, Human Resources Manager - Employee Engagement, to the meeting.
The report presented provided information to the Scrutiny Committee on the new National Apprenticeship Levy which would be introduced by the Government on 1 April 2017 and the implications for this within Lancashire County Council.
The report also highlighted to the Committee, the work being undertaken by the Skills Learning and Development Service in respect of 'Trailblazer' involvement, Graduates and Professional Trainees within the authority and the work to embed skills, learning and development into our services.
Questions and comments by the Committee in relation to the report were as follows:
· Members enquired how the Apprenticeship Levy would fit in with school budgets. It was confirmed that schools contributing to the levy would need to ensure that they had the budget to pay for an apprentice's salary.. The apprenticeship had to be a minimum of twelve months.
· School budgets were so tight that recruitment was almost non-existent. If the levy could be pooled for a number of schools this would prove to be more beneficial.
· The Committee enquired why the levy could not be used to pay salaries and had there been any information from the Government as to why this was the situation.
· It was acknowledged that the new process for the Graduate Scheme was an improvement on previous practice and members thanked officers for their work in this area
· It was pointed out that the Learning and Development Team was also working with vulnerable young people with no qualifications and not just focusing on graduates. The team had a priority for looked after children and care leavers. The team was divided into three parts:
1. Delivery of training and development of new legislation with social workers.
2. Working with graduates and professional trainees.
3. Working with schools, dealing with young vulnerable people and coaching them before they enter an apprenticeship
· 20% of any apprenticeship must be 'off job' training and this would have significant impact on the Learning and Development Team and it was working with providers to fully understand what this meant. The team needed to talk to providers as there was no guidance from the Skills Funding Agency (SFA) as to what the 20% would actually be used for.
· Members queried whether there should be more emphasis for the care sector. They were informed that there were qualifications being developed for apprenticeships in the social care sector.
· Learning and Development was doing a piece of work at the moment in terms of what was available for a framework standard both locally and nationally that could be delivered. The Team would then look at how these frameworks could be applied regarding the rules of LCC. The framework had to be relevant to the job.
· Learning and Development was not just looking at younger people regarding apprenticeships but also adults.
· Regarding the Level 7 Postgraduate Certificate – 'The Public Sector Professional' apprenticeship the Committee was informed that this would be signed off and ready for September. This was the first in the country. There was no word yet on when the Practitioner and Manager apprenticeships would be signed off. These had been proposed and developed by employers specifically for the children, young people and families sector.

The Chorley Town Centre Masterplan was first written in 2013 and it identified a number of key improvements for the town centre. This included the construction of the new ASDA store and associated public realm improvements. The South Market Street/Fleet Street area was improved with highway improvements for South Market Street completed in 2015. This linked in to the section of Market Street that was re-opened to vehicular traffic in 2012. The Town Centre Masterplan also set out a Public Realm Strategy for the Town Centre.
Chorley Borough Council (CBC) has engaged a consultancy, Planit, to review and update the Masterplan. Planit have been involved in the design of Fishergate in Preston and are also involved in the UCLAN project for the Adelphi Quarter. They have used this knowledge and experience to help inform the further development of the Masterplan.
The proposals contained in the refreshed masterplan will have an impact on the future management and maintenance of the highway. The design and materials will be agreed between Lancashire County Council (LCC) and CBC with a higher quality material palette than the standard specification for highway works.
The proposals will also mean changes to traffic movements and to waiting and loading provision. The impacts are not considered to be significant or be detrimental to traffic movements generally. Amendments to waiting and loading provisions will be managed on a scheme by scheme basis within an overall view of requirements.
As schemes come forward there will be a close working arrangement with agreement secured at an early stage on the design and construction arrangements. These arrangements will be subject to agreements under the powers of s278 of the Highways Act 1980.

In April 2016, as part of its commitment to support providers in delivery of the 30 hours extended entitlement, the Government announced it would be making £50m capital funding available for local authorities to submit funding bids for the creation of new childcare places.
In July 2016 the authority invited all eligible childcare providers in Lancashire to submit an application for funding. Childminders were not eligible to apply.
The authority received notification at the end of December 2016 that the Education Funding Agency had awarded funding to two of the six projects submitted by Lancashire totalling £1,466,130.

Carriageway lifecycle planning is an important aspect of highway asset management and involves drawing up long-term plans for managing an asset grouping with the aim of providing the required levels of service at the lowest whole life cost.
The Carriageway Lifecycle Plan identifies both the short-term routine maintenance needs and long-term capital costs and enables annual spend profiles per asset to be produced. It enables long-term predictions about the deterioration of various assets and their maintenance needs to be forecast.

At its meeting on 26 November 2015, Full Council agreed to adopt a policy that all bus stations operated or supported by the county council are self-financing. Following consultation with bus operators, they have indicated that the planned raising of charges will have a very serious effect on their ability to sustain bus services operating through bus stations. In particular, operators pointed to the undefined nature of the charges and gave a view that they may be paying for activities not directly related to bus operations. They also referenced substantial increased costs for the bus operators at Preston bus station coinciding with disruption, over the next two years, brought about by the refurbishment works at the bus station. In order to address the concerns of bus operators it is proposed to phase and revise the implementation of charges, as set out in this report whilst a fair funding mechanism is investigated and implemented.

This is to avoid the lane becoming a short-cut for drivers wishing to avoid the M55 J1 traffic signals.
A proposal has been advertised and consulted upon to make a traffic regulation order prohibiting driving on D'Urton Lane. The formal consultation has resulted in one objection which is addressed in the body of this report.

Central Lancaster High School (CLHS) has approached the local authority in relation to the future of its post 16 provision. CLHS has asked the local authority to start the formal statutory process to consult on the proposal to discontinue its post 16 sixth form provision by permanently lowering its age range from 11-18 years to 11-16 years, with effect from 31 August 2018. Under The School Organisation (Prescribed Alterations to Maintained Schools) (England) Regulations 2013, and the Department for Education's "Making 'prescribed alterations' to maintained schools" statutory guidance which was published in April 2016, the local authority must be the proposer for this type of significant change and carry out a statutory process, which includes publication, representation, decision, rights of appeal and implementation. In line with this, the authority is now required to decide whether to publish a Statutory Notice on the proposal to consult on the future of this provision.

Natural England has informed the County Council of the extension of the boundary of White Coppice Flush Site of Special Scientific Interest (SSSI). The boundary has been extended under section 28C of the Wildlife and Countryside Act 1981, to include more land that is considered to be of special interest. The enlarged site is to be known as West Pennine Moors SSSI.
The County Council has the right to make objections and representations (including those supporting the changes) about the notification.
The biodiversity and recreational value of the West Pennine Moors has long been recognised and the County Council has worked extensively with a range of partners for the conservation and enhancement of the Moors.
The SSSI includes land on the register of common land held by the County Council.
80% of the new SSSI area in Lancashire has previously been identified as Biological Heritage Sites. The notification of the SSSI will add further protection to the area and will help to deliver the County Council's strategic outcomes of a good environment while providing opportunities for people to access and enjoy the countryside as part of a healthy lifestyle.

In February 2016 the County Council resolved to cease funding the countryside service from April 2018. Revenue funding was stopped in April 2016, and the service is funded from reserves in 2016/17 and 2017/18. In the two year period before funding stops, it was resolved that attempts should be made to secure alternative arrangements for the future of the County Council’s 84 countryside sites so the public could continue to enjoy free access to as many sites as possible. In practical terms this meant identifying other organisations that could manage or own the sites.
On 28th June 2016 the Cabinet Member for Environment, Planning and Cultural Services agreed the selection and evaluation criteria to be used in the identification of organisations with whom the County Council could enter into negotiations to transfer the countryside sites which have been identified for closure.
The County Council has received eleven applications from organisations and individuals wishing to take over a number of the sites, and these applications have been evaluated in accordance with the agreed criteria.
This report provides details of the evaluations, and provides a number of recommendations for a way forward. The report is in two parts, firstly setting out the results of the evaluations and the impact on the sites; and secondly a range of activities that need to be carried out to keep the process of transfer and service transformation moving forward.
This is deemed to be a Key Decision and the provisions of Standing Order No. 26 have been complied with. Compliance with SO25 was not possible, the reason for this is that the proposals were not sufficiently advanced to allow publication of a notification 28 days in advance as required under SO25. In addition, there is an immediate need to inform five organisations that site leases will potentially transfer to them and they can begin to plan for the new financial year from April.

This report focuses on reviewing how we fund and procure supported accommodation services for young people. It is proposed that the retained £1.35M of Supporting People funding is pooled with current budgetary provision for supported accommodation for care leavers in order to provide a more cost effective approach to supporting young people.
This will be achieved by extending Supporting People contracts until September 2018 and reviewing processes in relation to assessment, prioritisation and control of access to Supporting People services, with a view to ensuring that young people to whom the County Council owes a statutory responsibility are able to access services.
Activity will be monitored by the Access to Resource Team and the findings will inform future commissioning intentions. In order to fulfil our responsibilities as a corporate parent and to avoid the "cliff edge" faced by care leavers at 18, it is proposed that services can be accessed by young people aged 16 to 21 years old.

The Chair welcomed Brendan Lee, Head of Service Special Educational Needs and Disability, to the meeting.
The Committee was informed that the Mental Capacity Act (MCA) 2005 directly impacted on work undertaken within the Special Educational Needs and Disability (SEND) service and subsequently officers had to have due regard for the remits of this legislation. The MCA had far reaching implications for the SEND service in relation to decisions that young people using their service were making with regard to their education and care. The MCA interacted with other key pieces of legislation such as the Children Act 1989 and SEND Code of Practice: 0 to 25 years.
Within SEND, good progress had been made in a number of areas of the Work Plan (September 2016). Pathways had been developed in relation to how the Children with Disabilities Team (CwD) and Integrated Assessment and Monitoring Team (IA&M) work with children and young people to undertake capacity assessments and, where appropriate, consider what was in their best interests. These were currently being consulted on by a number of practitioners with various areas of expertise. The cohort of young people to whom the MCA was applicable had been identified and the procedure for prioritising these young people was being developed and would be implemented in due course. Training was being commissioned from April 2017. Learning from case law and casework within Lancashire was ongoing and would inform the development of procedures and practice guidance. In the last 12 months the CwD Team had made seven applications to the Court of Protection under the MCA with no criticism received from the work undertaken in these cases. The SEND Service had successfully built good links with Lancashire's Mental Capacity Act MCA Co-Ordinator in the Deprivation of Liberty Safeguards Team who was providing advice and guidance where requested and had strengthened links with Legal Services to offer on-going support. In addition the MCA Working Group incorporated professionals with a range of backgrounds and knowledge.
Questions and comments in relation to the report were as follows:
· The SEND team had to consider if the children had the mental capacity to make their own decisions and understand the consequences of their actions before the team looked at deprivation of liberty.
· Regarding the Mental Capacity Act 2005 (MCA), concerns were expressed over deprivation of liberty for children. The primary goal of the SEND team was to protect the children. The MCA was about protecting liberty. It was very challenging for foster services and care services. There was a huge piece of legislation in regards to the MCA and deprivation of liberty with many complexities attached to it.
· Members felt there was scope for a briefing on the MCA and deprivation of liberty for all County Councillors. The SEND DoLs Sub-Group had felt that that this was a difficult and complex area of work and asked how far LCC could go as a local authority ensuring all the procedures were in place and children were protected

1. The Committee noted the progress made so far in relation to the implementation of the MCA within SEND and the development of policy, procedures and processes being developed to support compliant practice and positive outcomes for young people.

A report was presented on an application for the addition of a public byway open to all traffic from Main Road to Packet Lane, in accordance with File No. 804-578.
Details of the application and the evidence related to it, together with a summary of the law in relation to the continuous review of the definitive map and statement of public rights of way (in the form of Annex A) and of the effect of the Natural Environment and Rural Communities Act 2006 were presented both as part of the report and by officers at the meeting.
One Member was in favour of the byway being open to all traffic as she was concerned about the lack of access for emergency services and about excluding villagers from accessing this route.
Another Member queried whether a case could be built around a mechanically propelled vehicular route. Jane Turner confirmed that the evidence of use available showed that in the relevant 5 years, the main public use had not been vehicular and that to save the mechanically propelled rights more evidence of vehicular use would need to be produced, for this to be classed as a byway open to all traffic. David Goode informed the Committee that if they were minded to agree the recommendation to not accept the application for the byway to be open to all traffic, then if significant evidence became available, this would be referred back to the Committee.
It was stated that it should be made clear to the applicant that if they had more evidence of vehicular access, they needed to let the officers know and, if sufficient, it would be referred back to the Committee.
Resolved:
(i) That the application for the addition of a byway open to all traffic from Main Road to Packet Lane, Bolton le Sands, in accordance with File No. 804-578, be not accepted but instead a route of a different description be added;
(ii) That an Order be made pursuant to Section 53 (2)(b) and Section 53 (3)(b) and/or Section 53(c)(i) of the Wildlife and Countryside Act 1981 to add a restricted byway from Main Road to Packet Lane on the Definitive Map and Statement of Public Rights of Way as shown on Committee Plan between points A – B;
